Clap is offered a diversionary punishment, but the change in attorney will delay the resolution of the criminal charges against him.
On Monday, he appeared at Invercargill district court on charges of four willful damages and five willful damages. This included a charge of representative damage covering 31 properties and buildings in Invercargill CBD.
He was in his third court appearance, and had not yet entered a plea of guilty.
Last month, his lawyer Keith Owen told the court that there was a diversionary offer on the table. He had also successfully requested a remand for the judge to take it into consideration.
Owen, however, immediately asked for permission to leave the case when it was dropped on Monday.
He said, “I’m in a conflict.”
The Judge Duncan Harvey extended the bail to January 30th, noting that the offer of diversion was still valid.
Police use diversion to help offenders take full responsibility for their crime outside the court system, and to avoid a criminal history.
The objective of the court is to compensate the victim, and also to rehabilitate the perpetrator.
The man was still not allowed to use his real name and one of the bail conditions for him included that he could only leave home from 7 pm until 7 am.
