DOL has announced that the Occupational and Health Division of OSHA and the Wage and Hour Division of WHD are currently investigating child labor and safety violations within a Hattiesburg Mississippi poultry plant after the death of one 16-year-old employee.
Courtney Bohannon said, “We are seeking the assistance of current Mar-Jac workers as federal investigators try to learn how a 16-year-old child died at Mar-Jac Poultry’s Hattiesburg plant.”
OSHA has obtained a search warrant from U.S. District Court, Southern District of Mississippi. This will allow OSHA to enter the Mar-Jac plant and conduct safety investigations related to an incident. The warrant allows officials from the federal government to speak privately with any agents, employee or employer and also review documents related to operation and maintenance records of the equipment used in the incident.
Bohannon noted that the federal law “protects” workers’ rights to participate in an U.S. Department of Labor inquiry and prevents employers from interfering or retaliating in any way. Mar-Jac can provide a safer workplace for its employees with the workers’ help.
OSHA requested Hattiesburg Mar-Jac Poultry’s employees contact it or the Jackson-area OSHA office, or to file a confidential online report. In addition, the agency works with advocacy organizations like Immigrant Alliance for Justice & Equities of Mississippi in order to communicate with immigrant worker who may fear employer retaliation should they assist investigators.
OSHA reminded workers that, under federal law, all employees in the United States have legal rights to an environment free from hazards, and they can request OSHA to inspect their workplace if hazardous conditions are present.
OSHA says that Gainesville-based Mar-Jac Poultry, which is headquartered in Georgia, has hatcheries, feed mills and processing facilities throughout Alabama and Georgia. The company is a leading producer of 2 million poultry and 8.500 tons feed per week. They ship worldwide, mostly to the food industry.
Missouri contractor facing $205K OSHA fine
Troyer Roofing & Coatings in Jamesport (Missouri) faces an OSHA penalty of $205,369 for one willful offense, three serious offenses and one less serious violation. An 18-year old worker who was applying sealant onto a building’s rooftop fell more than 22feet and sustained serious injuries.
OSHA announced September 8th that the employer had allowed the foreman to finish his shift without using fall protection.
OSHA inspectors noted that while the employer did have fall-protection equipment on hand, they allowed their employees to make a decision about whether to use it.
Agent investigators concluded that not only did the contractor fail to teach employees how to properly use fall protection but also failed in ensuring they were protected. Troyer Roofing was also found to have failed in providing workers with eye and face protection. They did not even provide a written hazard notification program.
OSHA’s standard for construction fall protection (29 Code of Federal Regulations SS1926.501), cited 5,260 in Fiscal Year (FY) 2020, is their most frequently cited. OSHA’s second highest-cited regulation is the hazard information standard. It’s followed by the standards for eye and face protection, fall protection training standards and fall protection standard.
Karena Lorek said OSHA’s Kansas City Missouri area director in a press release that Troyer Roofing & Coatings had the opportunity to prevent this death of a young worker by requiring employees to use safety equipment. The employer did not require workers to wear fall protection equipment. This is a disturbing fact.
